General Terms of Use
Preamble
These General Terms of Use (hereinafter referred to as the "GTU") aim to define the terms of access and usage rules under which the Site provides access to various online services accessible via the following link: https://suez.mytroc.pro/en/hidden-index/
Access to the Site is subject to compliance with these GTU. Access to the Site is strictly reserved for the User as defined in these GTU.
When first accessing the Site, a window containing the GTU is displayed, and the User must accept them by checking the box: "I have read and fully accept the GTU."
The Publisher reserves the right to unilaterally modify or update these GTU at any time, based on changes or additions made, particularly to comply with legal, case law, editorial, and/or technical developments, as well as any modifications to the general terms of use of the Hosting Provider's services.
The User must regularly review the latest version of the GTU, which is permanently available on the Site.
If the User does not accept the GTU, they will not be able to access the Site.
The contractualization of paid transfers is specifically governed by the terms and conditions of sale specific to each section in "La Ressourcerie de l'Introuvable."
Definitions
In these GTU, words or expressions starting with a capital letter will have the following meanings:
Account: refers to the space created by the User to access the Site.
Cookie(s) refers to computer files stored on the User's computer hard drive.
Publisher: drefers to MyTroc, a simplified joint-stock company with a capital of 3 134€, headquartered at 1 rue du Docteur Labbe - 75020 Paris 20, and registered with the Paris Trade and Companies Registry under number 812 051 332.
Hosting Provider: refers to OVH, with which MyTroc, the service provider responsible for the development and management of the Site, has entered into a hosting contract.
Information(s): refers to all information and publications available on the Site.
Contribution(s): refers to all comments and/or content that Users can publish on the Site.
Site: refers to the website provided by the Publisher on the Internet and/or Intranet from the address: https://suez.mytroc.pro/en/hidden-index/
User(s): efers to a member of your community who has access to the Site after creating an Account, regardless of their location or the connection method. No User may transfer or donate goods that they cannot legally dispose of for professional purposes.
Recipient(s): refers to any User who accepts, on behalf of and for your community, through the Site, an offer to donate or transfer an item made by another User.
Donor(s) : refers to any User who, on behalf of and for your community, donates or transfers an item through the Site to another User.
Purpose of the Site
The purpose of the Site is to provide Users with a matchmaking service to facilitate, in accordance with the terms detailed in Article 3 of these GTU, the donation and transfer of new or used items for internal, professional use within your community, with the aim of maximizing their reuse and thus limiting waste and the cost of purchasing new items. Any use of the Site must comply with these GTU.
Access and Use of the Site
Access to the Site
Access to the Site is possible from a computer, tablet, or smartphone connected to a telecommunications network according to the communication protocols used on the Internet.
To access the Site, the User must create an Account in accordance with the provisions of Article 6 of these GTU. Access to the Site is done for each User by entering their professional email and password.
The Publisher grants the User the right to consult, use, and access the Information on the Site.
Cost of Access
Access to the Site is free and does not require a subscription. All software and equipment necessary for the use or operation of the Site, Internet access, or communication costs are the sole responsibility of the User outside of their workplace.
Each User is entirely responsible for their login data. Unless proven otherwise, any connection to the Site or data transmission made from the User's login information will be considered to have been made by the User.
Duration of Accessibility
User access to the Site is granted for an indefinite period, without prejudice to the User's or Publisher's ability to unilaterally terminate access at any time, without notice, reason, or compensation. The User acknowledges that in case of violation of legislative provisions and/or these GTU, the Publisher may block and/or terminate access to the Site without prior notice, with immediate effect.
Use of the Site
Offer Publication and Acceptance Terms
To create an offer, the User must complete a form specifying, among other things, the nature (donation or transfer), category, condition, item, and other characteristics of the Offer. In this context, the User commits to providing accurate, truthful, up-to-date, and complete information. The User agrees to carry out all necessary validations, checks, and clarifications to ensure that the description and elements of the Offer are accurate and do not mislead other Users.

The requestor may, however, make a counter-offer.
The offeror and requestor will agree on the place and date of delivery for the donation or transfer.
The User agrees to keep their offer available for a reasonable period of 3 days. After this period, the User may withdraw their offer without compensation, costs, or charges.
By registering, the User agrees that other Users may contact them via email or phone.
Subject of the Offer
No User may transfer or donate goods they cannot legitimately dispose of for professional purposes. Acceptance of the GTU by the User constitutes their commitment only to offer goods that they can dispose of.
Only items/products that comply with the law may be subject to donation or transfer on the site.
The Offer may only involve goods that the User can legitimately dispose of for professional purposes.
The User guarantees that no litigation or lawsuit is ongoing or about to be initiated regarding the items in the Offer.
Certain items are excluded, including:.
- Medications
- Live animals
- Food products
- Road or rail vehicles
- Weapons and ammunition
- Copies of physical or digital books, video games, music, software, or any content protected by copyright
- Electrical or electronic equipment that has not undergone prior data wiping in accordance with applicable company IT security rules
- Chemicals subject to a safety data sheet under the REACH regulation (Regulation No. 1907/2006 of December 18, 2006) and the Labor Code
- Items withdrawn from the market by the manufacturer or an administrative authority
- Non-hazardous and hazardous waste as defined in Article L541-1 of the Environmental Code
- Company items of heritage value.
These prohibitions are outlined in the User Charter.
Price
No specific constraints apply regarding the price.
User Obligations
General Obligations of the User
The User is prohibited, without this list being exhaustive, from:
- Using the Site for commercial purposes and, in general, offering products and services that directly or indirectly remunerate them;
- "Reselling" or making available to a third party and/or other Users, whether for a fee or for free, the content of the Site;
- Using the Site to send, in any form whatsoever, unsolicited advertising or promotional material;
- Directing internet users, either directly or indirectly, particularly through hypertext links, to other websites that may not comply with French legislation or the provisions of these Terms of Use (CGU).
Distribution of Obligations Between the Transferor and the Recipient
The Recipient must arrange, at their own expense and responsibility, the removal and transport of the transferred or donated goods from the location agreed upon by the Transferor and the Recipient, either using their own means or through a provider they have hired.
The Recipient undertakes to use the goods in a normal and appropriate manner according to the terms of the general conditions of use and assumes responsibility for them from the time the Transferor and the Recipient sign a document recording the date and place of the transfer of the goods.
The Recipient must use the transferred goods for internal and exclusively professional purposes.
If, after donation or transfer, the goods become waste under the French Environmental Code, the Recipient will be responsible for ensuring its treatment in compliance with regulations.
Site Availability
The Publisher will make every effort to ensure that the Site is accessible 24 hours a day, 7 days a week, except in cases of force majeure or events beyond the Publisher's control.
The Publisher reserves the right to suspend, interrupt, or limit access to all or part of the Site without prior notice, particularly for maintenance and updates necessary for the proper functioning of the Site and related equipment, or for any other reason, especially technical.
The Publisher is not obligated to guarantee the availability of the Site and cannot be held responsible for any interruptions and the consequences that may result for the User, especially when such interruptions are caused by the Host for maintenance or other needs.
The User is informed that the Publisher may terminate or modify the features of the Site at any time, without prior notice, and without the User having any recourse against the Publisher.
Site Hosting
Users are explicitly informed that the content published on the Site is hosted and stored on servers belonging to the company OVH, with which MyTroc, the service provider responsible for the development and management of the Site, has entered into a hosting contract.
User Account on the Site
Creating an Account
The User must create an Account to access the Site.
The User provides the Publisher with the required personal information. By completing the registration form, the User guarantees to the Publisher that the information provided is accurate, truthful, up-to-date, and complete regarding their identity and contact details.
The User undertakes to regularly update all information related to their profile to ensure its accuracy.
The reason for the suspension will only be provided upon request from the User and at the discretion of the Publisher.
The User agrees to create only one Account corresponding to their profile.
The User is solely responsible for any use of their passwords and identifiers (email address or others) and is the sole guarantor of their confidentiality, as well as any use of their Account.
Security
The User agrees to immediately inform the Publisher of any unauthorized use of their Account and any breach of confidentiality and security of their identification means by sending a message to the following address: https://suez.mytroc.pro/en/hidden-index/
If the Publisher has legitimate reasons to believe that the security of the Site is compromised or that it is being misused due to unauthorized use of the User’s identification means, the Publisher may temporarily suspend the Account, especially to preserve the integrity of the Site. If deemed appropriate, the Publisher may require the User to modify their identification means.
Account Deletion
The User is free to delete their Account or, if the User loses their password or encounters difficulties accessing their Account, by sending a message to the following address: contact us. contact us
The Publisher reserves the right to deactivate a User's Account after a period of total inactivity equal to or greater than one year. However, the User will be able to reactivate their Account upon express request to the Publisher.
Note that it is not possible to delete your account if a transaction is in progress.

Contributions
User Contributions are moderated after publication by a moderator of the Publisher, based on their compliance with French laws and regulations, as well as for any other serious reason.
The Publisher reserves the right to delete any Contribution without notice that violates these Terms of Use or that may, in whole or in part, expose the Publisher and/or the Host to liability. The Publisher may notify the User of the reasons for deleting the disputed Contribution, upon an express request made by the User to the Publisher.
The User is responsible for any Contribution they post via the Site and its consequences. The Contributions that the User submits, publishes, or displays may be viewed by other Users of the Site. The User should only submit Contributions they wish to share with others, in accordance with these Terms of Use.
The User agrees to post only truthful information and content, clearly indicating the source and author when borrowing from a pre-existing work.
Additionally, Contributions must not:
- Infringe intellectual property rights;
- Be defamatory, insulting, vulgar, discriminatory, or incite violence or hatred based on ethnicity, politics, sexual orientation, etc.;
- Contain obscene or pornographic content;
- Compromise the integrity and/or security of the Site, especially by containing viruses, Trojan horses, worms, time bombs, cancelbots, or any other program intended to damage or covertly intercept any computer system, personal data, or information;
- Expose the Publisher and/or the Host to liability by including hypertext links to illegal, infringing, or otherwise unlawful content, or to sites with restricted access without authorization from the right holders of the content.

Intellectual Property
In general, the User is prohibited from infringing the intellectual property rights (copyright, neighboring rights, database producer rights, trademark rights, domain names, etc.) of the Publisher and/or the Host, and/or any third party.
The Publisher owns all intellectual property rights related to the structure and content of the Site (texts, logos, images, sound elements, software, icons, layout, databases, etc.) or has acquired the necessary rights to exploit the structure and content of the Site without any limitation.
Thus, the User is prohibited, without prior, written, and express authorization from the Publisher, from copying, reproducing, representing, modifying, exploiting, or transferring any part of the Site's structure and content for any purpose.
Any unauthorized downloading is strictly prohibited unless explicitly authorized by the Publisher. Any abusive downloading that is discovered may lead the Publisher and/or any concerned third party to take appropriate sanctions. The trademarks and logos reproduced on the Site are registered with the relevant Offices by the companies that own them. Any reproduction of names or logos, by any means, without prior authorization from the concerned owner, is prohibited.
Failure to comply with these prohibitions may constitute an act of counterfeiting and/or unfair competition, engaging the civil and/or criminal liability of the User.

The user is informed that personal data processed on the platform are subject to computerized processing under the responsibility of MyTroc. As part of this activity, MyTroc takes great care in ensuring the security and confidentiality of the information in its possession and in protecting the personal data of users of its services, in accordance with applicable laws and regulations, particularly Law No. 78-17 of January 6, 1978, amended (the French Data Protection Act), and Regulation No. 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of individuals with regard to the processing of personal data and the free movement of such data (GDPR). MyTroc is committed to:
- Informing you about the personal data we collect,
- Explaining how we use your personal data,
- Ensuring the protection of your personal data,
- Guaranteeing your right to correct, transfer, and erase your personal data,
- Notifying you in case of any issues affecting the protection of your personal data.

Types of Data Collected
Data provided directly by users
This data is collected during subscription to the service, account creation, or when accessing any other offer or service. This includes:
- First and last names,
- Postal address, email address, phone number,
- Your service and position,
- Encrypted username and password used for identification.
The processing of this data (email, name, surname, address, phone number, position) aims to identify users, especially the addresses of establishments, for the purpose specified in Article 2 of these General Terms of Use.
Data we collect automatically
During each visit to the EcoBoutik platform, we collect information related to your connection and navigation. Various technologies may be used to collect this data, which includes:
- Device identifiers (IP address, Android ID, Apple ID, etc.),
- Type of operating system used (Microsoft Windows, Apple OS, Linux, Unix, etc.),
- Browser type and version used (Microsoft Internet Explorer, Apple Safari, Mozilla Firefox, Google Chrome, etc.),
- Dates and times of connection to our services,
- Referrer URL (the page you came from),
- Browsing data on our services, viewed content.
Purpose of Data Processing
The data collected is used by MyTroc solely for the proper provision of the EcoBoutik service. Personal data is collected for the processing of a professional exchange platform for employees to find and offer professional equipment, for the following purposes:.
- Managing, validating, publishing, and tracking user ads,
- Sending information on changes or updates to our services,
- Managing your rights regarding your personal data,
- Collecting statistical information on the use of the service by users.
Data is stored for 365 days or according to the legal and/or fiscal timeframe in effect (e.g., for invoices, accounting records, etc.).
Location of Data Processing
Data processing and the storage of personal data take place in France.
Recipients of Data
Some of the personal data collected by MyTroc may be transmitted to MyTroc as a subcontractor to assist with the execution of its activities. They are contractually obliged to protect the data and use it only for the purposes for which it was provided, in accordance with this policy.
Data Retention Period
Data is stored for one year after the last connection to the EcoBoutik platform. The data will be communicated to MyTroc (1 rue du Docteur Labbe, 75020 Paris) and the hosting provider OVH (2 rue Kellermann - 59100 Roubaix), or according to the legal and/or fiscal timeframe in effect (e.g., for invoices, accounting records, etc.).
Data Security
MyTroc and its subcontractors ensure the confidentiality, integrity, and security of the entrusted data by implementing appropriate organizational and technical measures, as well as enhanced IT protection. Data transmission is protected by a secure channel using the SSL security protocol. MyTroc employees are subject to strict confidentiality regarding members' personal data.
Right to Rectification, Data Portability, and Right to Be Forgotten
In accordance with personal data regulations, you have the right to access, rectify, oppose, delete, transfer, and limit the processing of your data. You can exercise this right by emailing mes-donnees@mytroc.pro with proof of your identity.

Analytical or Performance Cookies
To tailor the Site, its content, and services to the expectations of Users, MyTroc measures the number of visits, the number of pages viewed, as well as the activity of Users on the Site and their return frequency. To perform these audience measurements, MyTroc uses the MATOMO tool (formerly PIWIK), a website analysis service provided by MATOMO (open-source software) recommended by the CNIL. This tool is configured to ensure the anonymization of Users' data.
Generated data by the cookies concerning the use of the Site (including the IP address) will be transmitted and hosted by MyTroc on one or more server(s) located in France.

Guarantees/Responsibilities
The User undertakes, when using the Site, not to contravene the legislative and regulatory provisions in force, the proper use of the Intranet and netiquette, and these T&Cs.
The User is informed that any violation of the provisions of the T&Cs may result in legal proceedings and sanctions against him.
Under the same conditions, the User also undertakes to comply with the internal rules and practices relating to the use of the Publisher's information systems and networks.
The User undertakes to act diligently to respond to any claim.
The User is liable to the Publisher and/or third parties for any material and/or immaterial, direct and/or indirect damage of any nature whatsoever caused by the User, and/or his agents in the event of use not in accordance with these T&Cs.
The User guarantees the Publisher, as well as its parent, sister or affiliated companies, its representatives, its employees, its partners, and the Host, against any request, claim, demand and/or recourse of any kind, resulting from any violation of said provisions.
The User will indemnify them, at any time and on first request, against any damage and/or against any request, action, complaint from third parties resulting from any violation of said provisions. This guarantee covers both damages that may be paid, regardless of their direct or indirect origin, such as lawyers' fees, expert fees, legal costs, etc.
The Publisher undertakes to make its best efforts to implement technical and organizational measures to protect the Information circulating on the Site.
The User declares, however, that he is fully informed that the data is not protected against any form of intrusion, including by hacking.
The User acknowledges that it is impossible to guarantee total security of the data transmitted. Consequently, the Publisher cannot be held responsible for incidents that may arise from this transmission.
It is the User's responsibility to implement all useful means to preserve the confidentiality of the data transmitted.
Each User of the Site expressly undertakes:
- not to use software or processes intended to copy the Information on the Site without the express prior authorization of the Publisher;
- to expressly renounce using software or devices likely to disrupt the proper functioning of the Site, nor to take action likely to impose a disproportionate burden on the Publisher's infrastructure;
- not to alter or modify or even create derivative works from the Information on the Site without the express prior consent of the Publisher;
- to make short quotes, analyses and reproductions intended for press reviews or other uses expressly authorized by law only within the limits and conditions set by the latter and subject in particular to citing the name of the authors and the source;
- not to extract or reuse, including for private purposes, without prior written authorization from the Publisher, a substantial or non-substantial part of the content of the databases and archives constituted by the Site;
- not to collect information on third parties, including email addresses, in order to use them for sending commercial or equivalent solicitations, or to integrate them into a referencing service or equivalent, free or paid, or to carry out competitive monitoring;
- not to set up systems likely or likely to hack the Site in whole or in part, or likely to violate these T&Cs;
- to inform the Publisher as soon as they become aware of any infringement (in particular of the Publisher's intellectual property rights), in particular of any illicit or non-contractual use of the Site's Information, regardless of the method of distribution used.
The User who publishes an Offer on the Site acknowledges being personally liable, both towards third parties and the Publisher, in the event of a violation of the applicable legislative or regulatory provisions and therefore guarantees the Publisher against any disturbance, claim or eviction whatsoever. The publication of Offers on the site cannot under any circumstances be interpreted as a guarantee by the Publisher on the origin, truth or quality of what is offered. The Publisher will not be held liable for the non-execution or poor execution of donations or transfers concluded between Users, or more broadly in the event of conflicts or disputes between Users.

Nullity of a clause
The nullity in whole or in part of one or more provisions of these T&Cs, under a legal or regulatory provision or a final court decision, does not entail the nullity of the other provisions or of the part of the provision not affected by nullity.
Applicable law - Dispute resolution
These T&Cs are subject to French law.
In the event of disputes relating to the interpretation, validity or execution of these T&Cs, the User and the Publisher agree to use their best efforts to settle the dispute amicably.
In the event that an amicable agreement is not reached, any possible dispute relating to the interpretation or execution of these T&Cs will be subject to the jurisdiction of the courts of Paris.
By accepting these terms and conditions, you also agree to the terms and conditions of Mangopay.
